In a report on Friday, the Justices ruled that the Commonwealth should count all ballots, regardless of whether they have a handwritten date on the envelopes or not. The order applies to the 2021 judicial election count in Lehigh County. Justice Samuel Alito did warn in his dissenting vote that this issue could cause problems in the November election. Alito, along with fellow justices Neil Gorsuch and Clarence Thomas said that they believe a lower federal court ruling in Philadelphia which called the issue immaterial, was very likely wrong. This came after a challenge by Dave McCormick in the recent senate primary vote.
