Killer loses state Supreme Court appeal

WJAC reports that the State Supreme Court has rejected the appeal of James Cruz, who is in prison for the 1993 murder of 17 year old Dawn Birnbaum. The reports indicates that birnbaum’s boyd was discovered in a snow drift along I-99 near the Bellefonte exchange in March 1993. The girl was listed as a runaway from Maine. Cruz was convicted on DNA, tire track and gas receipt evidence, which put him in the Bellefonte area and connected him to Birnbaum. Cruz complained that the DNA evidence against him was not accurate, and those who analyzed the dna acted recklessly. The supreme court ruled Tuesday that there were no errors with the process and the appeal was dismissed.
