A 29 year old Lock Haven man is seeking release from prison while he appeals his conviction for his role in the Jan., 6, 2021 riot at the Capitol in Washington D.C. He’s Brian Gundersen who is basing his motion for release on the U.S. Supreme Court earlier agreeing to hear a challenge of the Justice Department’s interpretation of the “corruptly” obstructing an official proceeding charge. The official proceeding was Congress meeting to certify the results of the 2020 presidential vote. During a non-jury trial, Gundersen was found guilty of the obstruction charge and assault or impeding officers. Earlier this year he was sentenced to concurrent 18 month terms on each of the charges. Gundersen, has so far served two months of his prison sentence.
